Hadland v. Thompson, 2002 BCSC 380

Crystal Hadland was the back seat passenger in a single motor vehicle accident in October 1998. She was wearing her seatbelt when the defendant driver lost control of the vehicle and ran into two concrete abutments and ended up in a ditch. Hadland was taken to hospital and released the same day. Responsibility for the accident was admitted and damages were the only issue when the case went to trial.

Hadland claimed that her ongoing back problems and various psychological problems including depression, anxiety and panic attacks were attributable to the accident. She claimed that her pain would prevent her from living out her lifelong dream of running her own hair salon. Furthermore, her active lifestyle, both physically and socially, had been dramatically reduced because of the accident. Hadland stated that she was no longer the happy, carefree person who enjoyed life that she used to be before the accident. In support of her case, Hadland offered the evidence of her family physician, a rehabilitation specialist, an orthopedic surgeon, a psychiatrist, a radiologist, an occupational health physician and a vocational consultant.

The defence took the position that Hadland's back problem had resolved quickly and that her psychological problems were not caused by the accident but were related to cocaine and Ecstacy use, as well as trouble in her personal relationships. The defence also suggested that, had Hadland followed professional advice with regard to exercising and hiring a personal trainer, her back problems would have healed sooner and her dreams of being a hairstylist might still have been possible.
